Under direction of the Agricultural Labor Relations Board Executive Secretary, Board Members and Supervising Administrative Law Judge (ALJ), the ALJ presides over quasi-judicial hearings concerning representation issues, unfair labor practice charges and other issues under the jurisdiction of the Agricultural Labor Relations Act.

This position is eligible for National Judicial College Differential Pay. Incumbents who complete 20 hours of coursework related to administrative law adjudication may receive a monthly differential of five percent (5%).

Department Information The ALRB exercises jurisdiction over approximately 800,000 farmworkers and employers, providing collective bargaining rights to farmworkers that were specifically exempted from the coverage of the National Labor Relations Act (NLRA) in 1935. The California Agricultural Labor Relations Board was created in 1975 to ensure peace in the fields of California by guaranteeing justice for all agricultural workers and stability in agricultural labor relations. Headquartered in downtown Sacramento with regional offices throughout the state, ALRB employees are committed to, and guided by, the principles of the Agricultural Labor Relations Act, to "encourage and protect the rights of agricultural employees to full freedom of association, self-organization ... and to be free from interference, restraint, or coercion" (Labor Code § 1140.2).

Desirable Qualifications In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

Experience as an administrative law judge or as an attorney conducting administrative hearings; familiarity with the California administrative law and evidence code, labor law, the Agricultural Labor Relations Act (ALRA) and ALRB regulations. Experience conducting legal research including proficiency with Westlaw or Lexis; knowledge and experience related to issuing subpoenas and noticing depositions; knowledge of court and Board decisions interpreting the ALRA; knowledge of court and Board decisions interpreting the National Labor Relation's Act as it relates to the ALRA; court decisions interpreting the powers of administrative law and the judicial review of administrative actions.

Must have the ability to: perform research; analyses, appraise, and apply legal principles, evidence, and precedents to legal problems; make accurate summaries of evidence and prepare appropriate findings and conclusions of law and make recommendations based on such facts. Conduct fair and impartial hearings in a manner that will obtain all pertinent evidence and secure confidence and respect; maintain a fair and impartial attitude of mind without bias or prejudice; speak confidently and write effectively; establish and maintain cooperative relations with those contacted in the course of work.
