Returning from a Legat Program

Notwithstanding Sections 4.2.6., 4.2.6.1., 4.2.6.2. & 4.2.6.3., IA's returning from Legat Program IA assignments to domestic assignment will have the placement options described below. Placement within a FBIHQ division or field office is at the discretion of the receiving office's Division Head (or designee).
  • Permanent GS-15 FBIHQ ASC or UC position:
    • The SIA can compete for positions. To compete for GS-15 positions, the SIA must have passed the LSA; or
    • The SIA will be laterally reassigned (voluntarily, noncompetitive) at his/her permanent grade to the FBIHQ division to which he/he was assigned immediately prior to the foreign assignment. Reassignment will not result in a career enhancing title (i.e. UC to ASC); or
    • The SIA may step out of the supervisory position, be reassigned to the highest non-supervisory grade attained, and return to the FBIHQ division to which he/she was assigned immediately prior to the foreign assignment.
  • Permanent GS-15 field SSIA position:
    • The SSIA can compete for positions. To compete for GS-15 positions, the SSIA must have passed the LSA; or
    • The SSIA will be laterally reassigned (voluntarily, noncompetitive) at his/her permanent grade to FBIHQ via the DI/HRD Reintegration Board; or
    • The SSIA may step out of the supervisory position, be reassigned to the highest non-supervisory grade attained, and return to the FO to which he/she was assigned immediately prior to the foreign assignment.
    • Once the SSIA leaves a field SSIA position, they cannot return to that position but they can compete for other SSIA vacancies after completing the Legat assignment.
  • Permanent GS-14 FBIHQ/field SIA position:
    • The returning FBIHQ SIA:
      • Can compete for positions; or
      • Will be laterally reassigned (voluntarily, noncompetitive) at his/her permanent grade to FBIHQ via the DI/HRD Reintegration Board; or
      • May step out of the supervisory position, be reassigned to the highest non-supervisory grade attained, and return to the FBIHQ division to which he/she was assigned immediately prior to the foreign assignment.
    • The returning field SIA:
      • Can compete for positions; or
      • Will be laterally reassigned (voluntarily, noncompetitive) at his or her permanent grade to FBIHQ via the DI/HRD Reintegration Board; or
      • May step out of the supervisory position, be reassigned to the highest non-supervisory grade attained, and return to the FO to which he/she was assigned immediately prior to the foreign assignment.
  • Non-supervisory, permanent GS-13/GS-14 FBIHQ/field IA position:
    • Non-supervisory FBIHQ IA position:
      • The IA will revert to his/her permanent grade and return to FBIHQ via the DI/HRD Reintegration Board.
    • Non-supervisory field IA position:
      • The IA will revert to his/her permanent grade and return to the FO to which the individual was assigned immediately prior to the foreign assignment.
If an IA prematurely curtails a foreign assignment for reasons beyond his or her control, the IA will be awarded FBIHQ IA credit for the actual time served, is eligible to receive incentives, and is subject to the employee transfer policy (see the Employee Transfer Policy Guide (1138PG). Examples of reasons beyond an employee's control include, but are not limited to, loss of medical clearance of the employee or a family member at post; closure of the post of assignment; a draw-down of personnel or family members that materially changes the employee's household; and other such matters where the employee has no control over the events that are affecting the individual, his or her family, or the post of assignment. Employees who curtail their foreign assignments for medical reasons (employee or family) may request a medical hardship from the AAU, EDSPS, HRD.
If an IA prematurely curtails a foreign assignment for reasons within his or her control, the IA will be awarded FBIHQ IA credit for the actual time served, is not eligible to receive incentives, is subject to the Employee Transfer Policy Guide (1138PG), and, except at the discretion of the AD of IOD (for reasons documented by the AD in writing), may not be recommended for future assignments in the Legat program. Examples of reasons within an employee's control include, but are not limited to, performance or administrative deficiencies, premature departure due to selection for another competitive position to which the employee applied, premature departure due to acceptance of a PRL transfer, and other situations that are deemed not to be beyond the employee's control.

This position is designated as "emergency". As an "emergency" employee, you may be expected to report to work during periods of adverse weather conditions or other types of emergency situations when it is announced that an "unscheduled leave policy" is in effect or that federal agencies are closed in your immediate vicinity.

Key Requirements:

Major Duties GS-14:
• Initiate and coordinate collaboration with FOs and FBIHQ divisions, in order to further the FBI's GPS, TRP, and IPM
• Engage in threat analysis and forecasting regional threat issues, in order to identify threats and opportunities and inform substantive units at FBIHQ and FOs
• Advise LEGATs and IOD EM on intelligence activities in Legats and working with foreign partners
• Provide oversight and subject matter expertise to improve the quality and effectiveness of the Legat's intelligence program
• Maintain awareness of collection posture and provide guidance/recommendations to optimize collection against CI threats, to include drafting DI-approved products
• Drive collaborative intelligence production with foreign partners, when appropriate, using DI-approved products
• Draft or co-author DI-approved strategic products that support the Legat, FBI, and USIC
• Draft, coordinate and disseminate raw intelligence information
• Facilitate intelligence sharing by coordinating with internal and external foreign partners and OGA entities
• Meet and regularly coordinate with appropriate FO and FBIHQ division consumers to proactively identify and address relevant areas for program improvement, training, and threat briefs for OGA and foreign partners
• Liaise with senior intelligence counterparts and represent the LEGAT at meetings and briefings, when appropriate.
Qualifications and Evaluations
This is a term, NS GS-14 position; therefore, only GS-15, GS-14, and GS-13s who are eligible for a non-supervisory GS-14 in the 0132-job series will be considered for this position. Memorandum of Understanding (MOU): Work performed outside assigned duties (that would not normally be documented on an SF-50, I.e., back-up duties), has to be documented in detail by an immediate supervisor in order to receive full credit for amount of time worked in that position. FOR LEGAT POSITIONS ONLY
Affairs must be in order to allow departure on short notice. The selected applicant and Eligible Family Member (EFM) must be medically cleared by the Department of State
(DOS) and FBI prior to reporting to the Legat office. They must undergo a physical examination at a Government examining facility with satisfactory results and comply with medical requirements of both the DOS and FBI. If selectee or a family member is denied a medical clearance, employee &/or family member will not be allowed to travel to post. Selectee must receive both DOS and FBI medical clearances and selectee's EFM must receive a DOS medical clearance. In addition, selectee must be in full compliance with the FBI's Immunization Program Policy Guide (0990PG). Failure of the selectee to follow all requirements for DOS and FBI medical clearances and to fully comply with the FBI's immunization policy designates an individual as "non-deployable" and may result in a denial of foreign travel and ineligibility for foreign assignment.
Possession of SCI access is a requirement to serve in the Legat Program. While applicants are not required to possess SCI prior to application/selection/deployment, they must be eligible to apply for SCI access and maintain such access throughout their tour. Failure to obtain and/or maintain SCI access will result in removal from the Legat Program due to loss of effectiveness. Questions regarding an employee's eligibility for SCI access should be directed to their division's Security Office.
Host nation determines diplomatic status and it is their sole discretion under applicable international law. No recourse is available for adverse determinations. Employees and/or their accompanying immediate family members who hold, or have ever held, citizenship or dual citizenship in the country of assignment may be ineligible for diplomatic accreditation to that country. Failure to obtain diplomatic accreditation is grounds for rescission of a selection due to an inability to safely perform the duties and responsibilities of the position. The COM may also deny country clearance for any reason.
Withdrawal Policy
If an applicant withdraws 31 days or more after the closing date of a job opening, there is a 180-day penalty. Anapplicant must advise HRD and IOD, SAU of the withdrawal, and will be ineligible to apply for any future Legat Program job openings for 180 days from the date of the most recent withdrawal; applicants will remain eligible for any other Legat Program job for which he/she was an applicant at the time of the withdrawal. If the applicant withdraws from more than one Legat Program job opening after the 30-day period, the 180-day penalty will start from the date of the most recent withdrawal.
If an applicant withdraws after notification of their selection, he/she will be ineligible for any position in the Legat Program for 3 years from the withdrawal date. An applicant may request a waiver to the 3-year penalty period, if it was for a situation not within their control (e.g., medical issues or unforeseen family emergencies). SELECTEE WILL BE REQUIRED TO discuss potential transfer with spouse, significant other and/or family. Failure to report by the deadline may result in disqualification for further considered as a Professional Staff employee in the Legat program.
Pursuant to Section 3 of 1017PG and Section 4.5.3. of 1138PG, common household transfers, hardship assignments and telework options are not available to FBI employees accompanying their spouses on foreign assignment.
AVAILABILITY: Must be available to meet the needs of the FBI during emergencies or periods of heavy workload. Maintain conduct abroad at all time in accordance with Bureau standards. Travel both domestically, as well as internationally, from assigned overseas duty station in support of FBI administrative and/or investigative requirements. May be required to deal directly with police and other officials of the host country. Must possess exceptional interpersonal and liaison skills to work effectively in American Embassies. Understand that during the final stages of the hiring process, placement on an acceptance list for a Legat/COCOM position is tentative. A hiring decision is conditional upon the successful resolution of any outstanding inquiries or issues.
PASSPORT INFORMATION: Effective 07/02/2001, two-parent consent is required for any passport application executed for minors under age 14 unless the one parent can establish his/her sole custodial or guardianship status. WORKING CONDITIONS : Applicant must be available for an initial 1, 2, or 3-year tour of duty, depending on the assignment requirements of the Legat office. A tour renewal may be granted for Legat tours based on the Division's management action, the HR Officer or designee concurrence, as well as relevant operational factors, and the employee's performance appraisal rating is at least at the Successful/Consistent Performer level. Some Legat posts are designated as R&R posts which allows the employee and dependents to travel to the post's designated relief area or the United States (certain travel regulations/restrictions apply). An employee will earn home leave days while assigned abroad, but it cannot be used until completion of at least 24 months of consecutive service (12-month exception for Iraq/certain hazardous posts designated by the DOS). USG-funded travel using this leave will only be authorized when a tour renewal is granted after completing the initial tour requirements. Tour renewal travel requires approval by the Legat, IOD and FFD. To meet the operational demands of the FBI, all employees are subject to TDY assignments anywhere in the world, or directed (involuntary) reassignments on either a temporary or permanent basis. This may include hardship posts while assigned overseas (per Corporate Policy Directive 0224D).
Employees must be aware that foreign countries are not subject to United States federal laws related to concerns such as disability access and anti-discrimination. While some countries afford legal protections above or commensurate with those provided in the United States, there are others which do not provide the same level, if at all. It is incumbent upon the employee to research applicable local laws if this is a potential concern.
