The Office of Legal Counsel (OLC) provides legal support to the Department of Toxic Substances Control (Department). Under the general direction of an Assistant Chief Counsel, the incumbent is responsible for providing complex legal advice to all Department programs regarding various legal issues involving or affecting the Department In particular, the incumbent provides the most complex and sensitive legal advice to the Hazardous Waste Management Program (HWMP)regarding comprehensive state and federal environmental laws and regulations related to hazardous waste management, permitting, and regulatory requirements.

As an Attorney III you will have the opportunity to:
- Review hazardous waste management requirements for regulating hazardous waste facilities and handlers for consistency with state and federal laws, including both substantive requirements and technical adequacy
- Provide complex legal advice and guidance to Program regarding legal ramifications and opinions on permits, permit conditions and permit modifications
- Ensure that the Department's permitting decisions are made in compliance with requirements of the California Environmental Quality Act (CEQA) and CEQA guidelines by providing legal review of CEQA documentation, as necessary
- Coordinate the most difficult and complex litigation relating to permitting issues, including permit appeals, and challenges related to CEQA, hazardous waste, and Resource Conservation and Recovery Act (RCRA)
- Work with the Attorney General on litigation matters and assists the Attorney General with substantive law and Departmental policies and procedures
