Posting Details

The Alcoholic Beverage Control Division administers the New Mexico Liquor Control Act and the Tobacco Products Act. The Division is responsible for liquor and tobacco products licensure, compliance, permits for special events and festivals, server training certification, server training provider approval, prosecution of administrative violations of the Liquor Control Act and Tobacco Products Act by establishments and servers and other support functions. New Mexico is one of 32 states classified as a licensure state, where the alcoholic beverage industry is a private enterprise licensed and regulated by the state and is one of 12 states to require mandatory alcohol server training. New Mexico operates within a three-tiered system for alcohol and tobacco products distribution, meaning that alcohol and tobacco products are sold from the manufacturer to a wholesaler and then to a retailer. Currently, there are approximately 4,900 liquor establishment licenses in thirty-four different categories, approximately 1,600 tobacco licenses and approximately 67,000 active certified alcohol servers.

Why does the job exist?

The purpose of this position is to protect the public health and safety through licensure of those people serving alcohol and tobacco to the public. The incumbent must be professional and knowledgeable about New Mexico laws surrounding the sale, service and consumption of alcoholic beverages and tobacco products. The incumbent assists counsel with legal research, preparation of legal documents and correspondence, assists with processing of citations received by license holders for violations of the Liquor Control Act and the Tobacco Products Act, assists with document preparation under the Inspection of Public Records Act and assists with processing renewal applications for liquor and tobacco license holders. The incumbent answers questions and provides assistance to attorneys, business people, law enforcement, city and county governments and members of the public. The incumbent collects all fees due the State and ensures compliance with State law.

How does it get done?

- Assist counsel with legal research, preparation of legal documents or correspondence, assist with conducting administrative hearings and other tasks.

-- Assist with the review and processing of liquor license and tobacco license renewal applications. Checking applications for completeness and accuracy, verifying that applicants are in compliance with all laws and that all fees have been collected.

-- Assist with citation processing. Download and review police reports, enter citation information into the database, prepare correspondence to licensees and/or attorneys, receive payments for fines imposed ensuring that monies are properly credited to the correct account, and preparing reports and spreadsheets to track citation status and other citation data.

-- Assist with various office duties to include: Assist with processing of daily deposits, reviewing special permits, processing mail, assisting with front desk providing customer service in a very busy environment.

-- Assist with miscellaneous duties as assigned.

Who are the customers?

Our customers are alcohol servers, alcohol and tobacco license holders, product manufacturers, wholesalers, and the public. They are business people, attorneys, law enforcement, lawmakers and each citizen impacted by liquor and tobacco products.

Ideal Candidate

The ideal candidate will have experience working in an office environment, answering telephones, assisting customers, and working as a team to ensure that daily tasks are completed accurately and timely; will have experience working with law enforcement, attorneys, and the public; will have experience in drafting correspondence and preparing reports; will have good communication skills, both verbal and written; be polite and friendly; will have good computer skills and be proficient in the Microsoft Office suite (Word, Excel, Outlook, etc.), with an emphasis on Excel (should be able to create spreadsheets, sort, filter and compare data) will be able to multi-task, handle a large volume of work and be able to shift focus as needed and will have experience reading, understanding and applying statutes and rules. Spanish language skills are a plus, but not required.

Minimum Qualification

Employment Requirements

Must possess and maintain a valid Driver's License, a Defensive Driving Certificate and must pass applicant background check.

This position does not require supervision of employees.

Working Conditions

The incumbent works in an office environment. There is frequent use of computers, printers, scanners and telephones. There are extended periods of sitting. The applicant must be able to lift up to 50 lbs. There may be occasional travel.
