About this Role:

The Department of Health Care Services (DHCS), Office of Legal Services (OLS) is seeking an Attorney, Assistant Chief Counsel (ACC) specializing in public service employment law to join the team. The Program Integrity and Compliance Branch (PICB) Employment and Administration Section (EAS) partners with DHCS Human Resources Division (HRD) in supporting managers and supervisors regarding personnel management and supervision, including, but not limited to the probation process, performance management and progressive discipline, as needed. The PICB EAS represents DHCS in administrative hearings before the State Personnel Board, CalHR, Department of Industrial Relations and other state entities. The PICB EAS also provides legal advice and consultation on employment related matters for the DHCS Office of Civil Rights and Health and Safety Unit. The PICB EAS ACC supervises staff within their Section that may include Attorney IVs, Attorney Ills, Attorney Is, and paralegals/analysts as they prepare legal pleadings and litigation strategy, develop complex legal advice, and conduct varied litigation support activities. The incumbent assigns work, establishes Section priorities, and directs the overall activities of staff as they support DHCS' programs and divisions, including coordination with the Deputy Attorneys General and the Supervising Deputy Attorneys General on litigation related to or arising from these programs and divisions. The ACC could personally handle the most difficult and sensitive hearing and house counsel issues under their respective Section.

The EAS is part of the larger PICB. In addition to the employment related support provided to DHCS by EAS, PICB provides advice and counsel to support DHCS program implementation, policy development and ongoing administration; program integrity and compliance efforts (audits and investigations and appeals); compliance and enforcement activities related to managed care and licensing oversight for Substance Use Disorder treatment programs. The PICB also provides advice and counsel regarding conflict of interest (COI) inquiries for DHCS, including Form 700 filings, incompatible activities analyses, mitigation plans, and outside economic interest inquiries such as payments for travel and gifts. PICB also manages the DHCS PRA desk and service of legal process.

    Telework Information

    The DHCS standard for hybrid work is a minimum of two days per week in-person and site-based and up to three teleworking days per week. The amount of telework is at the discretion of the Department and subject to change consistent with DHCS' Telework Program and Government Code sections 14200 - 14203. This position may be eligible for telework up to five days a week, contingent on operational business needs.

    The selected candidate will be assigned an available DHCS office closest to their residence prior to their start date. The selected candidate will be required to report to their assigned DHCS office and other DHCS locations as needed.

    Business travel may be required, and reimbursement considers an employee's designated office and residence, subject to regulations and bargaining unit contract provisions. All commute expenses to the reporting location will be the responsibility of the selected candidate.
