About this Role:

The Department of Health Care Services (DHCS), Office of Legal Services (OLS) is seeking a permanent, full time Attorney, Assistant Chief Counsel (ACC) to join the OLS team. The ACC position is crucial in reaching our mission of providing Californians with access to affordable, integrated, high-quality health care, including medical, dental, mental health, substance use treatment services and long-term care. Each ACC supervises staff under their designated Section that may include Attorney IVs, Attorney Ills, Attorney Is, and paralegals/analysts as they prepare and review contracts, develop complex legal advice, and conduct varied house counsel activities. The incumbent assigns work, establishes Section priorities, and directs the overall activities of staff as they support DHCS' programs and divisions, including coordination with the Deputy Attorneys General and the Supervising Deputy Attorneys General on litigation related to or arising from these programs and divisions. The ACC personally handles the most difficult and sensitive house counsel and litigation issues under their respective Section.

The Contracts and Enterprise Technology Services (ETS) Section (CETSS), in the Benefits, Eligibility, and Operations Branch (BEOB), within the Office of Legal Services (OLS) provides legal counsel and advice to the Department's Directorate and managers, the Legislature, the California Health and Human Services Agency (CalHHS), and the Governor's Office regarding issues related to program and Department litigation specific to: contracts, ETS enterprise data and information management, utilization controls, and the California Medicaid Management Information System (CA-MMIS).

As a primary legal advisor on a wide breadth of issues, the CETSS is responsible for house counsel services including the development of sound legal strategies and recommendations necessary to support program implementation and ongoing administration; advisement on departmental administrative and technology support functions; and the provision of litigation support to the State and United States Departments of Justice.

The Attorney, ACC is highly experienced in complex legal house counsel issues and government contracts, and has a broad understanding of Medicaid, health, and technology law. The Attorney, ACC also has contact with managers throughout state service, healthcare providers, state contractors, and local, state and federal government entities, among others.

    Telework Information

    The DHCS standard for hybrid work is a minimum of two days per week in-person and site-based and up to three teleworking days per week in accordance with DHCS' Telework Program and Government Code sections 14200 - 14203. This position may be eligible for telework up to five days a week, contingent on operational business needs. The amount of telework is at the discretion of the Department and is subject to change.

    The selected candidate will be assigned an available DHCS office closest to their residence prior to their start date. The selected candidate will be required to report to their assigned DHCS office and other DHCS locations as needed.

    Business travel may be required, and reimbursement considers an employee's designated office and residence subject to regulations and bargaining unit contract provisions. All commute expenses to the reporting location will be the responsibility of the selected candidate.
