Summary

This position is located in the Office of the Solicitor. This office is responsible for providing legal advice to the Authority and its various components, and for representing the Authority in litigation. The incumbent of this position serves as a Attorney Advisor (Labor) and is assigned legal and factual assignments. Minimum education of Juris Doctorate, and admission to a State Bar, U.S. territory, or D.C. Bar is required.

Duties

Key Responsibilities: This Attorney-Advisor (Labor) position includes both litigation and non-litigation duties. The Attorney-Advisor (Labor) will assist the Office of the Solicitor in representing the Authority in all phases of federal appellate litigation, including brief writing and, as assigned, oral argument, including specifically, proceedings related to the review or enforcement of Authority orders in U.S. Courts of Appeal. As an Attorney-Advisor (Labor), the incumbent will handle difficult, comprehensive, sensitive, and precedent-setting cases and tasks across various functional areas.

Litigation Duties:

  • Appellate Litigation: Assist in representing the Authority in judicial proceedings involving petitions for review or enforcement of Authority orders filed under Section 7123(a) or 7123(b) of the Federal Service Labor-Management Relations Statute in U.S. Courts of Appeal, as well as cases filed in U.S. District Courts (excluding injunction cases under Section 7123(d) of the Statute).
  • Administrative Litigation: Support the Authority in administrative litigation, including petitions for appeal before the Merit Systems Protection Board (MSPB).


Non-Litigation Duties:

  • Legal Advisory: Assist in advising the Authority on legal questions arising from major case decisions or policy statements under the Statute. Provide guidance on legal matters related to other statutes, Executive Orders, or regulations that impact the operations of the Authority and the Federal Service Impasses Panel (e.g., Sunshine Act, Privacy Act, Ethics in Government Act, The Freedom of Information Act, and Privacy Act).
  • Regulatory Matters: Aid in the preparation and issuance of rules and regulations for the Authority.
  • Interagency Liaison: Serve as a liaison representative of the Authority in meetings with other government agencies, such as the MSPB, Equal Employment Opportunity Commission (EEOC), and the Department of Justice, where their activities intersect with those of the Authority.
  • Legislative Impact: Advise on the potential impact of proposed legislation on the operations of the Authority.
  • Legal Support: Provide legal advisory services on a wide variety of other legal matters as requested by members of the Authority, the Federal Service Impasses Panel, the Office of the General Counsel, and division chiefs within the Agency.
  • FOIA Requests: Assist in determining the appropriateness of requests for records, documents, or other information submitted to the Authority by the public and respond to requests under the Freedom of Information Act (FOIA), as amended.

Qualifications

Specialized Experience:

The selectee must have at least one full year (52 weeks) of specialized experience at the:

GS-09 grade level for the GS-11

GS-11 grade level for the GS-12

GS-12 grade level for the GS-13

GS-13 grade level for the GS-14


OPM Qualifications:

To qualify for the Attorney Advisor (Labor) position, applicants must meet the basic education and experience requirements for the GS-0905 series, as follows:

GS-11:

  • JD from an accredited law school and bar membership in good standing.
  • At least 1 year of specialized legal experience, or equivalent academic achievement (e.g., law review, clerkships, internships).
  • Demonstrated ability to conduct legal research, analyze legal issues, and draft legal documents.


GS-12:

  • JD and active bar membership.
  • 1 year of specialized legal experience in labor law, employment law, or a related field.
  • Proven ability to handle complex legal issues, including drafting legal opinions and representing clients in administrative proceedings.


GS-13:

  • JD and bar membership, with a minimum of 2 years of specialized legal experience in labor or employment law.
  • Experience managing legal cases independently, including representing clients in formal hearings or litigation.
  • Strong analytical skills and the ability to advise management on legal and policy matters.


GS-14:

  • JD and bar membership, with at least 3 years of advanced specialized legal experience focusing on labor law, employment law, or collective bargaining.
  • Extensive experience advising senior leadership, developing legal strategies, and managing high-profile or complex legal cases.
  • Exceptional communication skills and the ability to influence policy decisions.


This experience must have equipped the selectee with the specific knowledge, skills, and abilities necessary to successfully perform the duties of the position, including:

  • Expert knowledge of appellate and district court procedures.
  • Ability to gain expert knowledge in the Federal Service Labor-Management Relations Statute, including its rules, regulations, organizational structure, and management principles of the Federal Labor Relations Authority.
  • Basic knowledge of the Freedom of Information Act (FOIA), federal ethics regulations, and privacy regulations.


Key Abilities:

  • Analyze factual and legal issues in cases, identify necessary facts, and determine applicable legal sources.
  • Draft legal briefs and other litigation documents.
  • Investigate internal compliance and provide pertinent legal advice.
  • Effectively organize, self-manage, direct, and coordinate the work of others.


Bar Admission:

Applicants must be admitted to the Bar in any state, U.S. territory, or the District of Columbia, and be in good standing.
