Duties

The Deputy Division Chief, with the assistance of an Assistant Division Chief and Supervisory EEO Specialist, supervises investigations and resolutions of potential violations of the Communications Act and the Commission's rules to ensure effective and efficient enforcement actions of the FCC's EEO rules as applied to broadcast and SDARS licensees as well as MVPDs.

The Deputy Division Chief is an authority in the scope of the FCC's EEO rules as applied to broadcast and SDARS licensees as well as MVPDs. The incumbent maintains expert working knowledge of the EEO rules as they currently stand, how they have been applied by the regulated community as well as an in-depth understanding of the ways in which the rules have evolved and can evolve to be most effectively and efficiently applied. The Deputy Division Chief uses this expertise in law, policy and management issues in evaluating draft rulemakings and other associated governmental and Commission EEO-specific inquiries to align with Commission, Bureau and Division priorities and capabilities as well as to assist in the development of new policies, regulations and external communications.

The Deputy Division Chief helps plan and direct the Division's functions, manage workload, and develop Division priorities to achieve Commission and Bureau objectives. The Deputy Division Chief advises the Division Chief and Deputy and Assistant Bureau Chief(s) on matters having policy implications or significant impact on Division or Bureau activities. As Deputy Division Chief, the candidate will help plan, manage, direct, oversee, and supervise the Division's personnel, actions, issues and activities.

The Deputy Division Chief ensures that Division investigations conducted by attorney advisors and compliance reviews of EEO forms and filings by EEO Specialist staff provide outcomes consistent with Commission, Bureau, Division, and public priorities. The incumbent formulates goals and objectives for enforcement investigations, proceedings, other EEO program administration and determines the resources to be used in support of these activities. The Deputy Division Chief reviews staff analysis and written product, especially those considered important or precedent-setting. The incumbent helps lead IHD's efforts to coordinate internally with other FCC bureaus and offices, including extensive coordination with the Media Bureau and other technical staff, and to a somewhat lesser extent, external partner agencies (e.g., the Department of Justice, the Equal Employment Opportunity Commission, etc.). The Deputy Division Chief advises the other IHD Deputy Division Chiefs and/or Division Chief and other Divisions in the Bureau relating to EEO functions in the Division and informs them with respect to significant developments stemming from court decisions, new legislation, new rulemakings, and new industry practices which may have an effect on Commission policies and programs.

In consultation with the Assistant Division Chief, the Deputy Division Chief defines areas of responsibility and establishes policy and priorities for assigned staff. The incumbent keeps staff apprised of changes in emphasis or direction. Reviews and makes determinations within the scope of delegated authority, or recommends action to the Division Chief on matters arising from subordinate staff which have significant impact on programs. Keeps the Division Chief apprised of progress or work and directs action to achieve more effective operations.

Continuously evaluates the effectiveness of enforcement activities and determines need for changes to organization, staffing and resources. Selects/approves and/or recommends to the Division Chief the selection and/or recommendation of subordinate staff. Oversees development and administration of programs and policies for the utilization of personnel resources in keeping with Commission and EB goals, effective operation and merit system principles.

Establishes performance standards for, and evaluates the work of, subordinate employees. Makes recommendations on promotions, awards, reassignments and disciplinary actions to the Division Chief. Grants leave for subordinate personnel. Determines the need for and schedules formal training and ensures that orientation and on-the job training are provided where appropriate.

Qualifications

Applicants must meet eligibility and qualification requirements by the closing date of this announcement. Current Federal employees must meet time-in-grade requirements by the closing date of this announcement.

Professional law experience is experience that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position and is typically in or related to the work of the position to be filled.

In order to be deemed as "BEST QUALIFIED" candidates must meet both the educational requirements and the specialized experience requirements outlined below.

A. Education

You must meet the minimum basic educational requirements for Attorney positions.

Education requirements include: a professional law degree JD, LL.B., and/or LL.M.

If transcripts are not submitted at the time of application, a copy of the transcript must be submitted at the time of selection.

B. Specialized Experience

GS-15

Applicants must have a minimum of 4 years of professional law experience, including one year of specialized experience which must be equivalent to at least the GS-14 in the Federal service. For this position, specialized experience includes the following:

  1. Experience analyzing complex legal issues affecting federal regulatory matters and interpreting statutes, regulations and/or rulemaking documents;
  2. Experience directing and conducting in-depth, complex factual investigations and/or legal research on controversial and complex issues and producing decisional recommendations based on such investigations and research;
  3. Experience drafting, reviewing, and editing complex legal documents such as briefs, memoranda, and orders; making oral presentations before a variety of audiences communicating legal research results and defending legal positions; and
  4. Experience supervising attorneys and other staff with varying skill sets and diverse areas of expertise
