SENIOR FLSA COMPLIANCE SPECIALIST

RESPONSIBILITIES

This position is responsible for advising Insperity clients in their compliance efforts concerning Department of Labor (DOL) guidelines governing exempt/non-exempt classification issues under the Fair Labor Standards Act (FLSA), specific state laws regulating wage and hour issues, and administrative decisions. This position provides Insperity’s FLSA (wage and hour) review service for Middle Market and Emerging Growth clients with 50 or more worksite employees to assist with client compliance with FLSA and similar state laws and regulations for all 50 states. Also responsible for assisting clients in responding to investigations resulting from wage and hour claims filed through state agencies and/or the DOL.

• Assists clients in wage claim resolution process with state agencies by gathering information through client interviews and review of internal records and client documentation related to the claim.

• Shares facts of claim with key decision makers to determine best course of action (settle, pay, or dispute) when wage claims are filed with state agencies.

• Prepares detailed written wage claim responses to state agencies based on information provided by client interviews and records, and Insperity’s records when disputing a claim.

• Represents Insperity as a witness in wage claim hearings.

• Prepares clients for wage claim hearings and appeals process with ongoing support from receipt of claim through resolution.

• Prepares and assists clients in DOL audits.

• Acts as a liaison between the state agency and client when needed to explain co-employment relationship as it pertains to the payment of employment taxes and PEO/Client responsibilities under the CSA and certain federal and state laws.

• Refers complex human resources issues ascertained during wage claim investigations to management so that it can be shared with the appropriate Insperity team.

• Provides first level support, including discussion of best business practices, for escalated FLSA issues, wage claims or DOL audit matters as requested by department management.

• Provides guidance and shares knowledge with client key decision makers regarding the FLSA and related regulation in an effort to reduce client and Insperity potential liability.

• Provides assistance and guidance to relevant Insperity departments and personnel with questions or information needed for prospective clients and clients, related to exemptions and duties of worksite employees.

• Participates in ongoing conversations with key decision makers regarding exempt/non-exempt status of worksite employees.

• Assists with special FLSA review service when appropriate.

• Provides support, resources, and information to internal service providers, supervisors, and managers regarding requirements for compliance with FLSA as it relates to exempt/non-exempt issues.

• Assists with review of job descriptions as directed by department management, where appropriate, and provides pertinent FLSA resources.

• Researches federal and state requirements regarding job classifications, payment of wages, and overtime compensation.

• Provides first line support to team members when clients are resistant to compliance efforts.

• Participates in the escalation process with manager to resolve client issues with the exempt/non-exempt classifications under the FLSA.

• Maintains data and file documentation for the FLSA review service according to current procedures.

• Enters data and tracks FLSA review service activity for reporting needs.

• Utilizes Access, Excel, Word, Internet, Insperity OneVoice service tracking to accomplish the basic functions of the job.

• Completes FLSA team and/or HR Administrative Compliance COE special projects as assigned.

OTHER RESPONSIBILITIES

• Assists in the accomplishment of Insperity Company goals.

• Helps other employees to accomplish Insperity Company goals.

• Performs other duties as may be assigned by department supervisor.

• Participates in the Disaster Recovery plan as required.

EDUCATION / EXPERIENCE REQUIREMENTS

• High School Diploma or equivalent is required. Bachelor’s Degree in a related field is preferred.

• Four to six years of experience in a related field is required.

KNOWLEDGE / SKILLS

• Principles, practices, and procedures of general business including knowledge of: Fair Labor Standards Act, specific state laws regulating wage and hour issues, and related regulations and administrative decisions regarding job exemption classifications and payment of wages and overtime. Must have knowledge and ability to effectively reason legal issues; administrative and employment law issues involving payment of wages to employees; legal aspects payroll and tax compliance.

• Effective customer service skills; communicates tactfully and effectively, verbally and in writing; works efficiently and effectively under narrow time constraints; follows verbal and written instructions; has strong attention to detail; works independently under minimal supervision; maintains a professional demeanor, yet remains assertive with clients regarding compliance issues.

• Communicates tactfully and effectively, verbally and in writing; competent in correct English usage, grammar, spelling, punctuation, and arithmetic; familiar with modern office methods, practices, procedures and equipment, as well as filing systems and business letter writing; and maintains effective work relations with those encountered in the course of employment.

As required by the state of California, Insperity provides a reasonable range of minimum compensation for roles that may be hired in California. Actual compensation is influenced by a wide array of factors including but not limited to skill set, level of experience, and specific office location. For the state of California only, the range of starting pay for this role is between $67,725.00 and $70,180.00.
