Job Description:
Program Specialist V - Credentialing and Registry Enforcement (CARE) - Nursing Facility Administrator (NFA) Enforcement

This position serves as the administrator and oversees the Nursing Facility Administrator (NFA) Enforcement and NFA Criminal History (CH) Enforcement programs. Leads and conducts enforcement/compliance reviews for all referrals to the NFA Enforcement and NFA CH Enforcement programs. Oversees referral processes; ensures all NFA program referrals meet program requirements; ensures all referrals received from regions as result of survey/investigation findings and CH referrals from Licensing are tracked/processed timely; works extensively with Legal to interpret criminal histories to determine validity.

Coordinates with Special Investigations Unit for receipt/completion of referrals/investigations and accuracy of investigation reports. Oversees and offers due process to referred NFAs. Coordinates and conducts Informal Reviews (IRs). Coordinates and conducts Further Administrative Reviews (FAR). Coordinates with attorneys to prepare/testify for formal hearings. Imposes and timely enters final enforcement actions and tracks completion of sanctions. Implements and recommends changes/improvements to program procedures. Documents, tracks and analyzes program statistics and provides as requested to management. Trains and provides technical assistance and consultative work.

Prepares timely and comprehensive enforcement tracking worksheets (ETWs) to include the Issue Rule Application Conclusion (IRAC) review process for each NFA Enforcement and NFA Criminal History Enforcement referral/complaint. Confirms the determination of a compliance decision and conclusion to submit to the Governor-appointed Nursing Facility Administrators Advisory Committee (NFAAC) for review and recommendation of sanction. Acts as liaison to the NFAAC and Governor's Office to coordinate the submission and review of NFA referrals/complaints, schedules and coordinates quarterly NFAAC public hearings for the committee to review and recommend sanctions.

Works under general supervision of the Director of Credentialing and Registry Enforcement, with moderate latitude for the use of initiative and independent judgment.

Essential Job Functions:
Oversees and administers NFA program areas and provides interpretation of State laws/regulations for applicable entities, administrators, provider organizations, Legal staff, agency staff statewide, and the public.

Assists with oversight and maintenance of the integrity of the NFA Enforcement and NFA CH Enforcement databases and processes; makes timely and accurate database entries; assures timeliness of processing referrals/complaints, notification, due process and management of workflow. Ensures quality assurance for NFA Enforcement programs.

Conducts Enforcement/compliance reviews for NFA referrals from the regions and Special Investigations Unit (SIU) NFA investigations to ensure appropriate rule violations are cited and necessary information and documentation is provided in order to proceed with each referral.

Oversees and participates in the development and implementation of program guidelines, procedures, policies, rules and regulations. Monitors compliance with policies and procedures.

Coordinates and/or conducts IRs/FARs/Enforcement Reviews to determine compliance with licensure requirements, laws, regulations, policies and procedures. Coordinates and provides formal hearing testimony for NFA Enforcement and CH hearing before a State Office of Administrative Hearings (SOAH) Administrative Law Judge (ALJ). Conducts trainings and presentations for the NFA Enforcement and CH programs. Testimony, trainings and presentations are prepared appropriately; delivered professionally; and reflects an accurate representation of the facts, findings and agency rule/statutory requirements.

Analyzes and identifies processes/procedures in need of change, enhancement, or implementation to help ensure compliance with program policies/procedures. Develops action plans to meet program goals and recommends policy changes as needed. Continuously reviews the referral process to implement mandated changes; identify efficiencies; enhance effectiveness and make timely considered recommendations for change. Performs quality assurance activities for NFA programs, and performance measure tracking, analysis, and trends.

Communicates professionally and effectively (verbally and in writing). Verbal and written communication must be clear, concise and grammatically correct.

Knowledge Skills Abilities:
Graduation from an accredited four-year college or university with major course work in a field relevant to the assignment is generally preferred. Experience and education may be substituted for one another. Ability to gather, assemble, correlate, and analyze facts; to devise solutions to problems; to develop and evaluate policies and procedures; to prepare reports; to market program(s); to communicate effectively; to draft effective and professional written correspondence; and to train others

Initial Selection Criteria:
Graduation from an accredited four-year college or university with major course work in social work, criminal justice, human services, nursing or related field. Experience and education may be substituted for one another. A minimum of two years' experience conducting investigations of abuse, neglect and financial exploitation regarding individuals with intellectual disabilities, physical disabilities, mental illness and individuals who are elderly is preferrable.

Experience in a field relating to the agency program. Experience in program administration. Strong verbal and written communication skills and organizational skills are required. Ability to read, interpret, incorporate and communicate state and federal statute, rules, policies and procedures.
