The Developmental Disabilities Council (DDC) promotes advocacy, capacity building, and systemic change to improve the quality of life for individuals with disabilities. The DDC Office of Guardianship (OOG) is a statewide program that provides legal services and professional guardianship services for income-eligible New Mexicans who need a guardian; monitors and oversees guardianship services provided to the individuals it serves; and promotes and provides information on available alternatives to guardianship.
Why does the job exist?
The Compliance Officer position exists to ensure the people for whom OOG provides professional guardianship services can live as independently as possible, and receive the supports, services, and assistance to which they are entitled. The Compliance Officer does this by ensuring the professional guardians contracting with OOG comply with the terms of their contracts, and all applicable statutes, regulations, and ethical and professional standards applicable to adult guardianship in New Mexico. This position will work closely with protected people under guardianship, professional guardians, and OOG staff.
How does it get done?
The primary purpose of this position is to oversee and conduct investigations of complaints and grievances regarding services provided by professional guardians that contract with OOG. The Compliance Officer will interview the parties involved, including the protected person and the professional guardian, document their findings, review the applicable statutes, regulations, and ethical and professional standards, and provide a written justification concluding whether there have been any violations.
The Compliance Officer will also conduct Protected Person Welfare Visits (¿PPWVs¿) of people receiving professional guardianship services from OOG. PPWVs involve meeting with and interviewing the protected person, their professional guardian, and any other individuals in their lives as necessary, then writing a report addressing whether changes should be made to the guardianship and whether the protected person needs additional supports or services.
Finally, the Compliance Officer will also conduct and monitor Comprehensive Service Reviews to ensure guardianship contractors are complying with their contractual obligations. This will require maintaining appropriate documentation, providing sufficient support and assistance to the person under guardianship, and ensuring contractor compliance with applicable laws, regulations, and policies, as well as ethical standards promulgated by the National Guardianship Association. This position will also manage Corrective Action Plans and enforce contractual penalties if/when contractors do not meet the applicable standards.
Who are the customers?
Protected People living under guardianship and for whom OOG provides professional guardianship services; OOG¿s contractors and vendors; and New Mexicans with disabilities, their family members, and their communities.
Ideal Candidate
The ideal candidate for this position will have experience investigating complaints and grievances, including interviewing witnesses, reviewing documents, evaluating whether actions comply with applicable statutes, regulations, and ethical or professional standards, and writing a report concluding whether any statutes, regulations, or professional standards were violated; at least five years of experience working with individuals with disabilities, including working with guardians for individuals with disabilities; be fluent in Spanish; and be certified as a guardian by the Center for Guardianship Certification.
Minimum Qualification
Bachelor's degree in Business Administration and two (2) years of experience in investigations, regulation, policy, statutory, and/or contract compliance. Substitutions Apply. See Substitution Table below.

Employment Requirements
Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification within two (2) months of date of hire as a condition of continued employment. Must obtain National Guardian Certification within one year of hire.
Working Conditions
Work will be performed primarily in an office setting, with extensive personal computer and telephone usage, and extended periods of sitting. Must be able to work effectively with diverse client population including individuals with physical, cognitive, and psychiatric disabilities and limitations. In-state travel, including occasional overnight statewide travel. Must be able to lift 25 lbs.
